Limited Liability Indemnity

This page sets out the limits of our liability, and your indemnity to us, when you use babyshop.irish or buy from Baby Shop Company Ireland, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). It forms part of our Terms & Conditions.

Your rights under the law come first

Nothing on this page limits or excludes any liability that cannot lawfully be limited or excluded. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and your rights as a consumer under Irish and EU law, including the Consumer Rights Act 2022. Where those rights apply, they take priority over anything on this page.

Limitation of our liability

Subject to the section above, and to the fullest extent the law allows:

• We are not liable for losses that were not a foreseeable result of our breach when the contract was made, or for loss of profit, revenue, data or business opportunity.
• Where we are liable, our total liability to you for any claim is limited to the amount you paid for the goods the claim relates to.
• We are not liable for loss or damage caused by misuse of a product, by not following its instructions, or by normal wear and tear.
• We are not liable for delivery delays caused by events outside our control. If we cannot supply something you have paid for, we refund you in full.

Using our products

We do not claim that any of our products will prevent injury or loss. Please use each product as its page and its instructions describe, follow the age and weight limits given for it, and supervise children while they use it.

Website availability and third parties

We try to keep the site available and working, but it is provided "as is" and we do not promise uninterrupted or error-free access. We may suspend, withdraw or change all or part of the site without notice.

We are not responsible for fraud, theft, hacking, interception, tampering or other unlawful acts by third parties that are outside our control.

Your indemnity

You agree to cover us for any reasonable losses, costs and claims, including reasonable legal fees, that we incur because you have broken our Terms & Conditions, misused this site, or infringed another person's rights through your use of the site. This does not apply to anything you do as a consumer in exercising your legal rights.
